Sellers’ Tax and Social Security Obligations
Version 3.3 · In force from November 16, 2026
Information provided pursuant to Article 242 bis of the French General Tax Code (Code général des impôts).
1. Principle
The sums you receive by selling on Spotitem may be subject to tax and to social security contributions. It is your responsibility to declare them.
2. Private sellers
- The occasional sale of your used personal belongings (clothes, furniture, everyday items) is in principle not taxable.
- By contrast, the following are taxable in particular: the sale of jewellery, works of art, collectors’ items or antiques for a price exceeding 5 000 € (flat-rate tax on precious items or capital gains regime), and more generally the gains made by buying goods in order to resell them.
- A habitual sales activity carried out for profit is a professional activity: it must be declared (for example under the micro-enterprise scheme) and gives rise to social security contributions. You must then open a professional account on Spotitem.
3. Professional sellers
You declare your turnover in accordance with your tax and social security regime, and collect VAT where applicable.
4. Getting information and filing
- Taxes: www.impots.gouv.fr (“Individuals” and “Professionals” sections).
- Social security contributions: www.urssaf.fr and www.autoentrepreneur.urssaf.fr.
5. Spotitem’s obligations
- Each year, before January 31, Spotitem sends you a document summarizing the gross amount of the transactions received through it in the previous year and, where applicable, the information concerning you that has been reported to the tax authorities.
- Pursuant to Articles 1649 ter A et seq. of the French General Tax Code (Code général des impôts; European “DAC7” directive), Spotitem collects sellers’ identification information (name, address, date of birth or registration number, tax identification number, bank details) and reports to the tax authorities each year the sellers who have made at least 30 sales or at least 2 000 € in sales over the year; the sellers concerned receive a copy of the information reported.
- If you do not provide this information despite two reminders, Spotitem may suspend your payouts, then close your seller account.
