Listing, Ranking and Reviews

This document fulfills the information obligations of online platform operators under Articles L.111-7 et seq. and D.111-7 et seq. of the French Consumer Code (Code de la consommation).

• Logged-in user: the order is personalised. It takes into account: your affinity with the listing’s category (your “likes”, favourites, watch time, views, declared interests and purchases); how close its price is to the price of the listings you view; the tastes of users similar to you; the popularity and freshness of the listing (last 20 days). Listings already seen and those you have hidden are moved down. A share of approximately 20% of the results is reserved for discovering listings outside your usual habits.
• Visitor who is not logged in: listings are shown from the most recent to the oldest, subject to the sponsored slots (Article 4). In the video feed, they are ordered according to their popularity (last 30 days), their freshness and their geographical proximity to you (same postal code, then same département).
• Search: results are ranked according to their relevance to the search terms, then by date, subject to the sponsored slots (Article 4).
• The filters and sorting options you choose (price, category, date…) replace the default ranking.

• boost to the top: for 7 days, the listing occupies reserved slots among the first results (two slots out of five within the first twenty-five), allocated by rotation among the sponsored listings;
• exposure guarantee: the listing is moved up a few positions as long as its views target has not been reached.

Any listing promoted in this way bears the label “Sponsored”, both in the grid and in the video feed.

5.1 Who may rate. After an order paid on the Platform has been delivered, or after a hand-over that the buyer and the seller have both confirmed in their conversation (“confirmed transaction”), the buyer may rate the seller and the seller may rate the buyer, within 30 days of the delivery or confirmation. Each of them may rate only once per transaction. Only a transaction verified in this way gives this right: this is the check Spotitem carries out on the origin of ratings. Their content is not checked before publication.

5.2 Signed or anonymous rating. The author chooses to leave:

• a signed rating, published with their username and profile photo, together, if they wish, with a comment of 10 to 500 characters (a “review”);
• an anonymous rating, without comment: it appears under the label “Anonymous member” and the identity of its author is shown to no one, not even to the rated member. Spotitem keeps the link between the rating and its author in order to combat abuse; only authorised members of its team may consult it.

5.3 Display. Each rating bears the date of the experience rated (delivery or hand-over): to the day for a signed rating, which also bears its publication date; to the month for an anonymous rating, which bears no publication date. Each rating also bears a verification label: “Verified purchase” when it is based on an order paid online, “Hand-over confirmed” when it is based on a hand-over confirmed by both members. Ratings are shown from the most recent to the oldest; anyone may filter them by number of stars or choose another order among those offered. The average rating and the distribution of ratings take into account all ratings, signed or anonymous, and are recalculated once a day. The average rating is only displayed from three ratings; below that, the profile bears the label “New”.

5.4 Publication and retention periods. A rating is published as soon as it is submitted; the average rating and the distribution of ratings take it into account at the latest at the next daily recalculation. Ratings and reviews are kept until an account is deleted: deleting the author’s account erases the ratings and reviews they have given, deleting the rated member’s account erases those concerning them. Spotitem may also remove them (5.7).

5.5 Modification and reply. The author may modify their rating or review for 12 hours after publication, for example to correct a typing error; after that period, they can no longer be modified, nor deleted by their author or by the rated member, who may request their removal (5.7). The rated member may publish a single reply to a review, shown below it; it does not open a discussion thread. The Platform does not allow the author of a rating or review to be contacted from it.

5.6 Consideration. No consideration is granted in exchange for a rating or a review.

5.7 Reporting, challenge and moderation. A rating, a review or a reply may be reported free of charge by means of the “Report” button (Terms of Use, Article 13) or to [email protected]. The rated member may also ask Spotitem to remove or hide a rating or review concerning them, stating the reason for the request, in particular if they doubt its authenticity. Spotitem examines every report and every request; it may hide a rating or review, restore it or delete it where it is unlawful, contrary to the Terms of Use (insulting or defamatory remarks, personal data, advertising content, no connection with the transaction) or suspected of being fraudulent. It informs the author and the rated member of its decision and of the reasons for it.

The French version of this document prevails over any translation.
