9. Transfers outside the European Union

Some service providers (Cloudflare, Stripe, Google, Apple, identity providers) may process data in the United States. These transfers are governed by the European Commission’s adequacy decision on the EU–US Data Privacy Framework where the provider has joined it, or failing that by the European Commission’s standard contractual clauses. You may obtain a copy of them on request. The map shown on a listing is provided by the OpenStreetMap Foundation, in the United Kingdom, which the European Commission recognises as ensuring an adequate level of protection.

11. Recommendation and automated decisions

To offer you relevant listings, Spotitem automatically calculates a display order based on your interactions: categories viewed, favourites and “likes” (last 180 days), views and watch time (last 90 days), purchases, “hide” or “not interested” signals (last 180 days), declared interests, and the behaviour of users with similar tastes. The main parameters are detailed in the document “Listing, Ranking and Reviews”.

This processing produces no legal effect concerning you. No decision concerning you (approval or rejection of a listing, sanction, outcome of a dispute) is based solely on automated processing: such decisions are subject to human review. You can erase your viewing history, hide listings and object to personalisation by writing to [email protected].

12. Security

Passwords and PIN codes are hashed. The two-factor authentication secret and the carrier account credentials are encrypted (AES-256-GCM). Communications are encrypted in transit (HTTPS). The database is backed up every 30 minutes, in encrypted form, with a separate host located in the European Union (article 8). Access to data is restricted to authorised persons. In the event of a data breach presenting a risk to your rights, Spotitem notifies the CNIL and, if the risk is high, the data subjects, under the conditions laid down by the GDPR.

13. Deleting your account

You can delete your account from your settings once your orders in progress are completed (payout to the seller or refund). Deletion results in the erasure or anonymisation, in our databases, of your identification, contact, authentication and profile data, your unsold listings, the ratings and reviews you have given or received and your replies to reviews, your usage data and your preferences, as well as the deletion of your media from our storage spaces and the closure of your account with Stripe. The following are retained, solely for the period required by law or necessary for the defence of rights (section 10): orders, transactions and invoices; connection data; messages from conversations linked to an order; sold listings, attached to an anonymised seller. Erased data remains in the encrypted database backups until they are destroyed, at the latest 12 months later; these backups are only used to restore the service after an incident. A deleted account can no longer be used to log in. The Raccoin balance is lost.

14. Your rights

You have the right of access, rectification, erasure, restriction, objection and portability with respect to your data (GDPR, Articles 15 to 22), and the right to set instructions regarding what happens to your data after your death (Loi Informatique et Libertés, Article 85). Where processing is based on your consent, you may withdraw it at any time.

  • From your settings: edit your profile and contact details, erase your viewing history, hide your “online” status, manage your notifications, revoke a third-party agent’s access, download a copy of your data in a structured, machine-readable format, delete your account.
  • For any other request: [email protected]. We respond within one month, which may be extended by two months for a complex request; we may ask you to prove your identity in the event of reasonable doubt.

You may lodge a complaint with the French data protection authority, the Commission nationale de l’informatique et des libertés (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07 — www.cnil.fr.

15. Mobile applications

The applications request, at the time the feature is used, access to the camera, your photos and videos, notifications and, for photo certification, your location. You can withdraw these permissions at any time in your device settings.

16. Minors

The Platform is reserved for adults. Spotitem does not knowingly collect data concerning minors; if you believe that a minor has opened an account, write to us.

17. Changes

Spotitem may amend this policy. In the event of a substantial change, you will be informed by email or by a message on the Platform.

The French version of this document prevails over any translation.
